“SHAMS” center considers the decision of implementing death sentences against large number of citizens Gaza Strip as a critical precedent, instead of signature of the president. The decision was recently issued by Reform and Change Bloc which is affiliated with Hamas movement in Gaza. The approval of PLC members against 13 citizens represents a legitimation of m
urder, and a breach of the Palestinian Basic law as well as Penal Procedures Law number (3) of 2001. Such approval represents permission towards intentional murder.
“SHAMS” center calls for respecting the Palestinian Basic law as well as Penal Procedures Law number (3) of 2001. It is worth noting that Article 109 of the Palestinian Basic Law and articles 408 and 409 of Palestinian Penal Procedures Law number (3) of 2001 all emphasize that the death penalty cannot be carried out without the ratification of the president of the Palestinian National Authority.
Based on the Palestinian legislation, the center confirms that no party, other than the president of the Palestinian National Authority, has the authority to ratify death penalties; “SHAMS” center warns of the grave consequences of executing some citizens in the Gaza Strip since it will cause intensive damages on the social cohesions and community safety.
Also, it will result in serious reflections on social security. It should be mentioned that implementing death sentences without the ratification of the National Consensus Government is a political crime. “SHAMS” center appeals to neighboring and friendly governments as well as local, regional, and international human rights organizations to immediately stop Hamas from executions.
Furthermore, the center stresses its support and solidarity with families of the victims.
Also, it emphasizes that the call for abolition of the death penalty doesn’t indicate tolerating perpetrators charged with serious crimes.
