“SHAMS” center condemns inflicting death sentences upon three civilians and affirming another two sentences by the Palestinian Military and Civil Tribunals. Permanent Military Tribunal in Gaza Strip has inflicted three new sentences against Palestinian civilians on 18/4/2016.

Moreover, the Supreme Military Tribunal has affirmed another two sentences to be ready for execution once approved by the president, due to being accused of espionage with enemies. Permanent Military Tribunal in Gaza Strip inflicted death by handing upon three civilians who are: (A.Q) 52 years old from Rafah, (W.A) 41 years old from Gaza city and (M.D) 31 years old from Wusta governorate.

Also, the Supreme Military Tribunal affirmed two sentences one by firing squad against (N.A) 38 years old from Gaza city and who was assuming a military position.

And the other is by hanging against the civilian (A.SH) 31 years old from Gaza City. So, number of death sentences issued in 2016 only increases to be 10 sentences.

“SHAMS” center criticizes the Palestinian judicial system (the Military and Civil) for disregarding the right to life by and inflicting the death penalty effortlessly. No doubt, judiciary is an independent power in its functions, and judges are independent and working for law enforcement.

Additionally, independence of judiciary represents an absolute goal for achievement of justice and contributes to stabilization of prosperous life. So, if the judicial system isn’t independent, then justice will not be achieved since justice is the essence of the governing system.

“SHAMS” center emphasizes that prosecuting civilians before military courts is a violations against human rights, and contradicts article 30 of the Palestinian Basic Law. The first paragraph stipulates that submitting a case to court is a protected and guaranteed right for all people and each Palestinian shall have the right to seek redress in the judicial system.

Also, it contradicts the Palestinian Military law (4) of 2008. Therefore, prosecuting civilians before military courts is a constitutional breach.

“SHAMS” center appeals to the Palestinian President so as not to confirm death sentences.

In addition to use his constitutional authorities towards the abolition of death penalty from the Palestinian legislations.
