Human Rights and Democracy Media Center- SHAMS, asserts that the Failure of the United Nations Security Council to issue a compulsory resolution to ceasefire in the Gaza Strip is, in itself, a form of aggression on Palestinians. The failure is a Green Light granted to the Israeli occupation to proceed in committing massacres against Palestinians. The continuation of providing political coverage for the Israeli occupation in the Security Council to proceed with its aggression and crimes against Palestinians in the Gaza Strip is a manifestation of the bloodshed mentality that dominates the politicians of some of these countries and the tendencies of these countries. Moreover, it reveals that the United Nations and its arms are performing a functional role to serve the interests of the permanent states members of the Security Council. Such a situation violates all the diplomatic values and noble principles that the United Nations was established to maintain. At the same time, it violates the various international conventions and treaties.
The Center affirms that the United Nations was created by the countries that won in World War II to be a tool for these countries within international politics. Since the establishment of the United Nations, up to date, it has performed a functional role in serving the interests of the countries that won the war, in clear contradiction with its charter and the noble principles on which it was based, among which is protecting international peace and security. Nothing was done by the Security Council although the Secretary-General utilized his authorities (detailed in Article 99 of the Carter) to draw the attention of the Security Council that there was a threat to international peace and security resulting from the aggression against the Gaza Strip. Despite that, the countries partners with the occupation in the aggression are still going on in violating the international law and the United Nations Charter.
SHAMS Center affirms that the claim of the occupation, which pretends that it is in a case of self-defense, is nonsense and has nothing to do with international law. No Article or text within the International law gives the occupier the right to self-defense against the occupied. What was stated in Article 51 of the Charter of the United Nations, does not apply to the Israeli occupation in the Occupied Palestinian Territory. This Article is related to states in the status of peace and are not under military occupation or being attacked. Therefore, resisting the occupation is a right affirmed by the international law.
SHAMS Center condemns the stance of the United Nations, which used the Veto against a drafted decision presented to the United Nations to stop the Israeli aggression on the Gaza Strip. 13 countries members of the Security Council voted in favor of the decision while the United Kingdom abstained from voting, as it used to do, while the United States of America voted against. The stance represents challenging the international tendency and supporting the occupation in its aggression against Palestinians in the Gaza Strip. The role of the United States was not limited to this but was extended to provide the occupation with all forms of support and aid, which indicates that it is a partner with the occupation in the genocide war committed against Palestinians in the Gaza Strip.
SHAMS Center reminds the United Nations, the Organizations annexed to it, and the non-governmental international organizations that the acts and crimes committed by the Israeli occupation against Palestinians and civic objects in the Gaza Strip represent violations of international law and international humanitarian law. In particular, the Israeli crimes violate the Geneva Conventions of 1949 and the protocols annexed to them. Additionally, Israel is violating the Hague Convention (IV) respecting the Laws and Customs of War on Land (1907) as well as violating the Rome Statute of the International Criminal Court. These institutions should initiate immediately to fulfill their legal, moral, and rights protection responsibilities, and exert pressure on the occupation’s state to halt its profound violations of human rights in the Occupied Palestinian Territory.
SHAMS Center condemns the war crimes, crimes against humanity, and genocide crimes committed by the Israeli government to maintain its power and remain in office. The Israeli government is going on in the war for the sake of justifying its control of governance in the occupation state. The Israeli radical government is using war against the Gaza Strip as a justification to extend its term of service and the term of its head, who is accused of several corruption cases. The Israeli Ministers are using the Palestinian blood as a tool to ensure that they will remain in power. The Israeli government is giving a deaf ear to the internal demands inside the occupation state to dismiss the current government and arrange early public elections.
SHAMS Center condemns the drafted law proposed by the Knesset member Moshe Beisel, to evacuate Palestinians from the Gaza Strip. The drafted law is entitled “A law to absorb the residents of the Gaza Strip” and states that any Palestinian willing to leave the Gaza Strip forever will receive 6 thousand USDs while ten thousand USDs will be paid to the hosting country. The law is utilized as a tool by the Israeli government to uproot Palestinians from their land and end their national question. The law represents a recall of the transfer policy, as one of the pillars of the Zionism Movement thought and the behavior of the Israeli various governments. Displacing 1.8 million Palestinians in the Gaza Strip is a clear indication of the transfer policy that the Israeli government has been applying since the beginning of the current aggression. Ethnic cleansing and displacing people are among the major components of the Israeli policy.
SHAMS Center calls upon all the Palestinian political factions, national groups, and the various Palestinian institutions to adopt a unified Palestinian strategy and achieve national unity to be able to face the challenges imposed on Palestinians. Palestinians should be unified based on a national program to face the emerging circumstances that accompany the ongoing aggression on Palestinians currently in the Gaza Strip and West Bank. There is a need to renew the political representative institutions within the Palestinian political regime and arrange public elections on a democratic basis to ensure that all Palestinians enjoy the right to participate in electing their political representatives to both the legislative and executive authorities.
The Center warns against the proposed invitations and scenarios (spreading widely currently), as they harm the essence of the Palestinian National Project and Palestinian Constants. Among these constants is the right to self-determination and the establishment of a Palestinian Independent State by international legitimacy resolutions. Following the enormous sacrifices of Palestinians and their suffering, it would not be acceptable to go back to the same circle, bet on the nonsense peace reconciliation and valueless negotiations, and depend on the United States Administration to achieve a peace reconciliation. There is a need to identify a clear ceiling for any future political process and identify clear international references for such a process based on international resolutions and international legitimacy. Such a process has to be under the auspice of the superpowers that are pro of the Palestinian question, (mainly Russia and China) and at the same time, to enhance the national liberation process to end the Israeli colonialism of Palestine.
