“SHAMS” Center stresses that the acceleration of the issuance of death sentences against Palestinian citizens in the Palestinian territory will deepen the crisis between the citizens and the justice institutions. The citizens are wondering about the real problem behind the judicial overload that is affecting all the levels of courts, whether in the regular courts, sharia courts, or in the criminal cases, labor cases, financial cases and family cases. At the time that High Criminal Court and the military courts are racing to issue more death sentences against the citizens, the labor cases or a property dispute cases take more than a decade. So, we have the right to wonder about the reasons behind the speedy adjudication in the cases that related to murder.
“SHAMS” Center stresses that the confessions that were obtained by the citizens in the case of bombing attempt the former Prime Minister’s motorcade on 13\3\2018, that “Hamas” was accused by the President of Palestinian Authority of attempting to assassinate the former Prime Minister Dr. Rami Al Hamdallah, the Deputy Minister of interior, the former Director of National Security General Tawfeeq Abu Naeem by an explosive device was placed in his car, and the murder of two officers from the security forces in the accident of Al Shoobany cemetery in Al Nessarat Camp in the middle of Gaza, have been obtained under duress and torture. It is worth mentioning that military appeal court of the Military Justice Authority in Gaza has sentenced to death by hanging on Saturday 9\4\2002 against the citizen (A,Gh), he was born in 1989 and he is a civilian from Al Nesserat Camp. As well, he is arrested by the military persecution since 28\3\2018, and he was convicted of murder in contravention of the article (378) and disrupting public order in contravention of the article (175) of the revolutionary panel code of the year (1979). Also, the court sentenced to hard labor for life and imprisonment with hard labor for 7 or 5 years.
“SHAMS” Center calls on to do not prosecute the civilians before the military courts. Given that the above mentioned citizen was court martialed before the military appeal court of the Military Justice Authority in Gaza, in accordance with unconstitutional revolutionary panel code No (5) of 1979, which is a violation of article (30) from the Palestinian basic law and a blatant violation of the right to fair trial.
