Ramallah: Human Rights and Democracy Media Center “SHAMS” mentioned that Israeli prime minister’s praising his heavily armed soldiers represents a green light for murdering more Palestinians. The Israeli soldiers who attack the innocent Palestinian citizens in Gaza Strip and cause the falling of hundreds of victims. So, he gave them permission to keep killing martyrs and hurting injured among the innocent civilians. On the political context of the Israeli occupying state, this means that he is providing the legal, judicial, and political protection for his soldiers and officers so they and preventing any possible international criminal prosecution. Accordingly, the excessive usage of power & weapons by the Israeli army against the peaceful demonstrations arise as a kind of orders, instructions and praising.
The center stressed that the Israel, the occupying state isn’t allowed to use the power or take legal & political measures in its administration of the occupied Palestinian territories since the occupation’s law enforces protecting Palestinian civilians and their properties. As well, International Humanitarian Law enforces providing guarantees for people included in the protection. It is worth noting that principles and guarantees of protection have carried different jurisprudence & legal explanations, like the advisory opinion regarding the case of the Apartheid discrimination wall issued by the International Court of Justice in 2004. This opinion has given space to discuss the principles of war occupation and apply it on the Israeli pattern concerning violations against human rights and the International Humanitarian Law.
The center added that International Humanitarian Law forbids taking inhuman actions by the occupying state, based on Geneva Fourth Convention relative to the protection of civilians and their right to life, while incriminates inhuman actions.
Furthermore, “SHAMS” center explained that International Community, particularly the United Nations are requested to necessary provide the protection for innocent Palestinians from the Israeli violations and excessive crimes which have never been stopped foregoing or following the occupation of the lands. Besides, the center put emphasis that UN postponement to provide protection for the Palestinian people, and to restrain the Israeli occupation, and not to compel it to respect Israeli obligations being the occupying state raise questions. In regard to the credibility of the UN, adopting the policy of double standards and being controlled by the superpowers. The center assured that resolutions issued by the UN and its institutions since1947 until present are no longer significance unless forcing Israel to comply with resolutions of the International Legitimacy.
In the same context, “SHAMS” center called for formulating an international investigation’s committee to go into the grounds of the crimes and massacres committed by the Israeli occupation against innocent citizens in Gaza Strip on March 30th, 2018 and April 7th, 2018 and targeting the journalist Yaser Murtaja intentionally. Moreover, the center put emphasis that inquiry made by the Israeli occupation to its soldiers is worthless, and it will never waive the criminal, political, legal and ethical liability of the different levels of the occupation. Since the findings of these interrogations are already known, representing a play with bad script and acting.
